SoundWiseRX™
This Privacy Policy explains how we collect, use, disclose, and protect personal information in connection with the SoundWiseRX™ platform, our websites, and related services (together, the “Platform”). The Platform provides early childhood neurodevelopmental screening, assessment, and enrichment tools for children ages 3–9 and the parents, guardians, clinicians, and educators who support them.
The Platform is intended for children. Unlike most software services, we knowingly collect and process information relating to children. We treat that information with heightened care and we do not use it for advertising. Sections 4 and 8 describe the specific protections that apply to children’s information under the Children’s Online Privacy Protection Act (“COPPA”) and other applicable law.
The Platform is operated jointly by Scout Quest Education, Inc. (a California corporation, the “Platform Operator”) and SoundWise4Kids, Inc. (a Delaware corporation, which owns the SoundWiseRX brand and the screening, scoring, and clinical methodologies), together with SoundWiseRx, Inc. (a Delaware corporation) (collectively, “we,” “us,” or “Company”).
SoundWise4Kids, Inc. is the controller of screening and scoring data; Scout Quest Education, Inc. is the operator and processor of the Platform. Counsel should confirm this allocation holds for each category of data.
We collect the following categories of personal information:

We collect from a child only the information reasonably necessary for the child to participate in a screening or enrichment activity. We do not condition a child’s participation on providing more information than is reasonably necessary.
We use personal information only to operate and improve the Platform and to meet our legal obligations, including to:

Because the Platform is designed for children, we comply with COPPA and take extra steps to protect children’s information:
If we learn that we have collected a child’s personal information without the consent required by law, we will promptly delete it.

Some Platform information — including screening scores, developmental indices, and clinician entries — may resemble or constitute health information. Where the Platform is used by or on behalf of a HIPAA-covered entity (such as a physician’s practice) and we act as a business associate, we handle protected health information under a Business Associate Agreement and applicable law. We keep personal information only for as long as reasonably necessary for the purposes described in this policy, including to provide the Platform, maintain a child’s records for the responsible adult, meet legal, clinical, tax, and accounting obligations, and resolve disputes. When information is no longer needed, we delete or de-identify it. A parent, guardian, clinician, or account holder may request deletion earlier as described in Section 8.

To exercise these rights, contact us using Section 13. We will verify your identity and your relationship to the child before acting on a request. We will not discriminate against you for exercising your rights.
If a school or district uses the Platform, we act as a “school official” with a legitimate educational interest under the Family Educational Rights and Privacy Act (“FERPA”) and any applicable state student-privacy laws. In that case we use student information only to provide the service to the school, we do not use it for advertising or to build commercial profiles, and we return or delete it at the school’s direction. We use administrative, technical, and physical safeguards designed to protect personal information, including authenticated access, encryption in transit, access controls, and monitoring. No method of transmission or storage is completely secure, but we work to protect information and to respond promptly to any incident.
Residents of California and certain other states have specific rights, including the rights to access, correct, and delete personal information and to opt out of sale or sharing for targeted advertising. We do not sell personal information and we do not share it for targeted advertising. We do not knowingly sell or share the personal information of anyone under 16. To exercise any state privacy right, contact us using Section 13.
We may update this policy from time to time, such as when the law or the Platform changes. If we make a material change, we will post the updated policy here with a new effective date and, where required by law or where the change concerns children’s information, notify the responsible account holder.
